Platform Terms

These Platform Terms govern access to and use of the Proficient Health platform, including PH Capture®, PH Exchange®, PH Connect®, related authenticated applications, customer portals, support environments, and hosted services operated by Proficient, Inc. (“Proficient Health,” “Company,” “we,” “our,” or “us”).

Certain products, services, features, or platform capabilities may be governed by separate customer agreements, licensing terms, statements of work, business associate agreements, or other applicable contractual documentation.

Access to certain platform features may be restricted to authorized users designated by customers or approved organizations. Users are responsible for maintaining the confidentiality of account credentials and for all activities occurring under their accounts.

Users may not misuse the platform, interfere with system functionality or security, attempt unauthorized access, introduce malicious code, or use the platform in violation of applicable laws or customer agreements.

Customers and authorized users are responsible for maintaining the accuracy of information submitted through the platform and complying with applicable privacy, security, and healthcare-related obligations associated with their use of the services.

Separate authenticated platform and customer application environments may facilitate the transmission and processing of healthcare-related information, including referrals, laboratory-related information, and operational healthcare workflow data, pursuant to applicable customer agreements, privacy obligations, and security requirements.

All platform software, content, workflows, designs, and related materials are owned by or licensed to Proficient Health and protected by applicable intellectual property laws.

Proficient Health may update, modify, suspend, or discontinue portions of the platform from time to time in order to maintain, improve, secure, or enhance the services.

Use of the platform may also be governed by the following:

• Privacy Policy
• Terms of Service
• Cookie Policy
• Do Not Sell / Privacy Choices
• Customer agreements
• Business associate agreements (BAAs)
• Service agreements
• Applicable onboarding or implementation documentation
